Description of Activities
Description: The Commission resolved to approve without conditions the acquisition by Mr. Johannes Homateni George of an immovable property because of a sale in execution under a High Court Order with case number: HC-MD-CIV-ACT-CON-2020/01884 dated 3 August 2021.
The acquiring group: The acquiring group has business interests in health education, training, health care services, consultation, and other related services. In addition, providing security services, manufacturing and supply of medical equipment and furniture, consultancy services, software development, stationery and corporate gifts, printing, and corporate embroidery. The target undertaking is an immovable property, Erf 3955, Swakopmund (Extension No. 10), Republic of Namibia, and is currently being leased by the acquiring group.
Relevant market: The Secretariat, looking at the activities of the merging parties,s defined the product market as the Swakopmund real estate zoned “Industrial’’.
Merger Determination
The Commission found the proposed transaction unlikely to result in the prevention or substantial lessening of competition or result in any undertaking to acquire or strengthen a dominant position in the market and did not raise any public interest concerns.
However, as stated under section 50 of the Act, this approval does not relieve parties from complying with any other mandatory statutory approvals that any of the parties to this merger must comply with under Namibian laws.
